(hereinafter “we” or “Seller”). The version of these General Terms and Conditions of Sale in force at the time of the order shall apply. The language of the contract is German.
§ 2 Conclusion of the contract
The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking the order button at the end of the checkout process, you submit a binding offer to purchase the goods contained in your shopping cart. The contract of sale is concluded as soon as we accept your order by means of an express order/shipping confirmation or by delivering the goods. Receipt of an automatic acknowledgement of your order does not yet constitute acceptance of the contract.
§ 3 Prices and shipping costs
All prices stated in the online shop are final prices in euros (EUR) and include the statutory VAT applicable in each case (standard rate in Italy currently 22%). Shipping costs may be charged in addition to the stated product prices; these are shown separately during the ordering process before the order is completed. No minimum order quantity applies.
§ 4 Payment
Payment is made using the payment methods offered during the ordering process. These include in particular common credit and debit cards, Apple Pay, Google Pay, Shop Pay, PayPal and bank transfer (payment in advance). Only the payment methods actually displayed and selectable at checkout are authoritative. The purchase price becomes due for payment upon conclusion of the contract.
PayPal: During the ordering process you will be redirected to the PayPal website, where you confirm the payment. The PayPal terms of use apply in addition.
Bank transfer (payment in advance): If you choose bank transfer, you will receive our bank details with your order confirmation. Please transfer the invoice amount within 7 days, stating your order number as the payment reference. Goods are shipped once payment has been received; in this case the delivery time under § 5 begins upon receipt of payment. If payment is not received within this period, we reserve the right to cancel the order.
§ 5 Delivery, delivery time and shipping costs
We deliver to the following countries: Germany, Austria, Italy, Belgium, the Netherlands, Luxembourg, France, Spain, the United Kingdom and the Czech Republic.
- Within Germany, Austria and Italy, the flat shipping rate is €7.90. For orders of €75 or more, delivery is free of charge.
- For the rest of the delivery area (Belgium, the Netherlands, Luxembourg, France, Spain, the United Kingdom, the Czech Republic), the flat shipping rate is €14.90. For orders of €149 or more, delivery is free of charge.
Delivery usually takes 2–3 working days from conclusion of the contract. Goods are carefully packed and shipped insured. Delivery times are non-binding approximate figures, unless a fixed delivery date has exceptionally been bindingly agreed.
§ 6 Retention of title
The goods delivered remain our property until payment has been made in full.
§ 7 Right of withdrawal for consumers
Consumers have a statutory right of withdrawal of fourteen days. For details, conditions, the statutory exclusions (in particular for goods sealed for hygiene reasons, such as opened essential oils, cosmetic and food products) and the model withdrawal form, please refer to our withdrawal information. It forms an integral part of these General Terms and Conditions of Sale.
§ 8 Warranty / statutory guarantee of conformity
The statutory warranty provisions apply. In particular, consumers are entitled to the statutory warranty (legal guarantee of conformity, “garanzia legale di conformità”) under the Italian Consumer Code (Codice del Consumo) for a period of two years from receipt of the goods. The essential oils we offer are natural products without preservatives or other chemical additives.
§ 9 Liability
We accept unlimited liability in accordance with the statutory provisions for damage resulting from injury to life, body or health, and for damage caused by gross negligence or intent. Otherwise, our liability is limited to the foreseeable damage typical of the contract. Mandatory statutory liability provisions, in particular under product liability law and consumer protection law, remain unaffected. Our products are intended for use as directed; please observe the respective product and application instructions.
§ 10 Alternative dispute resolution
The former EU Online Dispute Resolution platform (ODR platform) was discontinued on 20 July 2025. The European Commission provides information on out-of-court dispute resolution and an overview of consumer dispute resolution bodies at https://consumer-redress.ec.europa.eu. Our e-mail address is info@pinusalpium.com. We are not obliged, and in principle not willing, to participate in dispute resolution proceedings before a consumer dispute resolution body.
§ 11 Applicable law, place of jurisdiction and final provisions
The law of the Italian Republic applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are acting as a consumer with your habitual residence in the EU, the mandatory consumer protection provisions of the country of your habitual residence remain unaffected by this choice of law. Should individual provisions of these General Terms and Conditions of Sale be or become invalid, the validity of the remaining provisions shall remain unaffected.
